I recall my six year old self, carefully checking each can of tuna my mother placed in our shopping cart, seeking out that little smiling dolphin to confirm that my lunch would be free of dolphin massacre. So much has changed since those would be conservation efforts. Earle does not forget to mention the smaller, less thought of creatures-the shellfish. Earle opens her chapter with a history lesson centered on oysters, at one time in our history- she notes â€Å"†¦. they were described as hazards to navigation. † (Earle) Today, few would ever say abundant in the same sentence as oysters. Earle pay homage to the importance of the shellfish in our ocean, discussing everything from clams to my personal favorite-the octopus, whom Earle notes as a critical part of the ocean’s health. Earle closes her shellfish segment with a sentence that hits close to home. â€Å"I have decided to cease and desist, hoping that every lobster I don’t eat, will increase the chances that somewhere a lobster might live, and do what lobsters do as a part of a healthy ocean. † (Earle) With that statement, I immediately connected on a personal level to Earle. As a devout vegetarian, I too, have hopes that every animal I do not eat, will aid in the future of that species, and ultimately, our planet’s future. She lends advice however, to these dynamic and complex issues- and it is all so simple. Do not take, what you cannot replace, and do not take what you know nothing about. The world is a vampire- sent to drain. Earle’s second major concept of her book is the relentless greed of the human race. Through pollution, ignorance, and pillaging of all resources, the human race has become that of a vampire species, feeding off of the seductive lure of power, money, and claim that our planet’s oceans bring. A particular lipstick wearing, wolf hunting politician made a statement that is becoming unanimous with most of America today- â€Å"Drill baby, drill. For the unknowing, that is Sarah Palin, a woman who agrees with offshore, and in some cases, onshore drilling. The topic of oil is sensitive. Do you drill in former wildlife and marine reserves to avoid wars with your supplying companies? Most of America, even the left minded Barak Obama was nodding to the idea of on and offshore drilling in the United States’ backyard. The steadily rising price of fuel and oil are making more Americans nod yes, than ever before. Earle is shaking her head no. largely because the action occurs underwater, out of the public view, little attention has focused on what actually happens on the ocean floor where drilling takes place, or what creatures are displaced by the thousands of miles of pipeline laced across the bottom†¦Ã¢â‚¬  (Earle)Despite my serious vendetta against Sarah Palin, I myself, had not actually considered the impact of pipelines on the ocean floor, I was always more focused on oil spills and the tragedies which take place thereafter. Earle does make serious mention of oil spills, reliving the Exxon Valdez casualty that permanently damaged the Alaskan shoreline. The book even features the text of Earle’s testimony before Congress on the recent oil spill in the Gulf of Mexico. It is not the spills, the pipelines, or the seeping of the oil that sets a tic for Earle†¦ it’s the use of the oil itself. The subject everyone has heard about, even if they didn’t want to. It doesn’t take Al Gore to make one think or hear about climate change. The 1950’s were a time for poodle skirts, milkshakes, and good old fashion family values, along with cigarettes, seat beltless cars, and DDT. My point is it should not stun anyone that emissions are impacting the planet in a â€Å"negative† way. Earle seems to feel the same. â€Å"Civilization currently thrives on oil based economies, and is continuing to do so despite herculean efforts to move away from fuels that pollute the planet today and will potentially shorten the number of tomorrows our species will have. † (Earle) Sylvia Earle is not an extreme leftist; she is an educated woman who has worked beside oil engineer leaders, government officials, and offshore experts. I believe it is these credentials that make her so magnetic, and tune readers’ thoughts to her direction. Her powerhouse chapter on oil has n Achilles’ heel, her lack of insight on solution. It is not as though she has an answer and it is not as if she is not willing to share, it is that no one has a surefire way to reroute the flight of emissions. This chapter, though mind-blowingly effective, still has an unfinished climax, much like our planet. Uneducated or Unwilling to learn? Earle is consistently using the same explanation throu ghout her book as to why individuals are not taking more action. In every chapter, she highlights examples of attitudes and expressions from people associated to the topic. Earle’s book is one of the tools our society now has to combat the epidemic of the uneducated on the subject of anthropogenic damage to nature. There is not a single environmentalist who at one time did not face the reality transition of a need for change. The issue is entirely complex and tedious because alongside the uneducated, are the unwilling. There has been an outward cry on the subject of climate change from Christians, denouncing it as political corruption, or that climate change is merely an effect listed in the book of Revelations. Earle does not seem to let the major issue of uneducated and unwilling affect her view on the future. She positively lists the strides being made to better understand the ocean. In Earle’s closing chapters, it is as if she is taking the reader by the hand, and showing how we can all make a difference. I found Earle’s book to be stirring. I have definitely become something of a cheerleader for Earle after reading this book. As a woman pursuing conservation science as a career, I found Earle to be a keen example of what one person can do in their field that can change the thoughts of others worldwide. Earle took her opportunity as an author, and produced an extraordinary document that covers every issue associated with the ocean and humans, but goes a step beyond outlining what’s wrong. Earle uniquely includes what is right, and what is currently being done to change the course of the future. I have read several books on environmental issues, and none have so effectively utilized the opportunity to educate and motivate individuals like Earle has done in her book. Earle has motivated me to keep fighting the good fight. I often struggle over if my work with polar bears ill ever be worth anything, and Earle’s book was the push I needed to continue on. Even if I do not know the outcome, at least I can say, I have made the effort in my lifetime to try. Earle sets a standard for each reader, to simply make choices in favor of the planet, and its oceans. We may not all have the ability to write books, give speeches, or work directly alongside the ocean, but we all have choi ces we can make to better our tomorrow. We are living in a time of great uncertainty, and are all faced with a forked road ahead of us. One leads us to certain extinction, the other to opportunity to at least try to change for the better. The world is blue today, but what will it look like tomorrow? What will our children see when they look to the sea? The answer lies entirely on our willingness to change. Will we be the generation who turned the course of the planet around? Or will we be the generation who had the opportunity and denied our own species, and so many others a future? The radius of the circular motion and thus the length of nylon string L cannot be kept constant throughout the circular motion because there may be a variance of the force applied to keep the paper marker on the level of glass tube. Thus, t he string and paper marker may move up and down and the accuracy of the tension T may be affected. 4. The stopwatch is controlled by human hands. Thus, the reaction time of human brain (around 0. As) may lead to inaccuracy and affect the measurement of time taken and hence the accuracy of angular velocity is affected. 5. There may be miscounting in the number of circulations, because the time for 50 revolutions is quite long and students may be distracted. How Writing About My Hardships and Sharing My Weaknesses is Leading to My Success Ive written, published, and received monetary compensation about my bipolar illness since 1995. Though risky to divulge my shortcomings, its also rewarding. My bipolar material first appeared in literary magazines. Kaleidoscope, udsakron.org/kaleidoscope.aspx, specializing in both mental and physical disability, printed The Prodigal Daughter, the first bipolar story I ever wrote. The Missouri Review, missourireview.com/, and The North American Review, http://northamericanreview.org/, picked up my fictional stories with mentally ill main characters, formulated on my personal experiences with the illness. Having Anne, published in The Missouri Review, was shortlisted for an O. Henry Prize in 2000. A big, mental health publication bp Magazine is completely devoted to discussing bipolar illness. I wrote a few humor pieces for these folks. I turned to venues on the internet. Â  In EmpowHER, empowher.com/, I wrote about my early years with bipolar illness, and how I came down with the disease, how I was first treated, how I struggled to adjust, and how my friends and family reacted. I received more positive feedback for that gig. People liked how I made my mental illness experiences funny through lite bipolar personal essays. In being sincere about your trials and tribulations, you can find acceptances for your material because editors discern that youve been there, and you know what youre talking about. Â  In a way, youre an expert on misery. Â  Then theres always write what you know. In reality, my life is problematic and often tough, but its also filled with joy because suffering ultimately brings empathy for people, and thats what its all about. This describes very well the different forms that Dracula can take and the last bit of the sentence just creates that extra bit of suspense, which can take this play to the next level. and he can at times vanish and come unknown This is the phrase which kicks in that extra bit of suspense and gets the reader wondering what this means and how Dracula does it. It overall draws a better picture of the creature himself and what is achievable for him. He can transform himself to wolf, as we gather from the ship arrival in Whitby, when he tear open the dog; he can be as bat He can come in mist which he create This is another of the forms that Dracula can take and as you progress on with the story you get a better and better image of Dracula and the powers that he has within him. Another one of the conventions is the weirdness of Dracula and how different he is in relation to the rest of mankind. He eat not as others. Even friend Jonathan, who lived with him for weeks, did never see him to eat, never! This is very weird, as we all know because every living thing needs to consume something in order for its body to keep functioning and to stay alive. But it seems as though Dracula is very different compared to humans as Jonathan, who had lived with him, had never seen him eat. This must mean that there is another way in, which Dracula consumes which has not yet been discovered. This part of the story creates suspense and gets the reader thinking about what Dracula exactly is and how he differs humans. It gets the reader thinking about how Dracula survives and what he survives on. He throws no shadow; he make in the mirror no reflect This is another phrase, which creates suspense for the reader and shoes just how weird Dracula is and once again it gets the readers thinking just what Dracula is. As we know everything and anything can throw a shadow as long as it is solid. The laws of physics tell us that. But Dracula somehow doesnt throw a shadow. This means that he is defying the laws of Physics, which once again shows how unusual and how inhuman like Dracula is. The last quotation which gets the reader wondering about Dracula is He can see in the dark-no small power this It isnt a small power indeed as no human can do this, which ultimately confirms just how inhuman Dracula is. The convention of the journal will be looked at next. Minas journal has a lot to reveal about Dracula and her encounter with him. The first quotation I will take is the parted red lips, with the sharp white teeth showing between; and red eyes This is a quote which strikes fear into the mind of the readers and it gives a fairly good description of Dracula. The sharp teeth instantly gets you thinking and gives u a sense of fear as u begin to picture what this person may look like. The red eyes also instantly puts fear into the minds of the readers as it describes Dracula in a very fiery/inhuman way. The word monster may come into the readers minds as they read this phrase. Silence! If u make a sound I shall take him and dash his brains out before your very eyes Here we are getting pretty gruesome as the writer takes a more graphic approach to the threat that Dracula makes to Mina. The very thought of someones brains being dashed before you instantly sends a shiver up your spine and gets you very involved in the passage as your brain instantly gathers an image of what it would look like if you were to be there. This slowly paints a better picture of Dracula and what he is capable of and what he has done before. Another chilling quote from Dracula is: You may as well be quiet; it is not the first time your veins have appeased my thirst This is a very chilling quote, which refers to the blood in Minas body. It gets the reader thinking about whether or not Dracula is about to do what they think he is about to do. But straight after there is another quote, which describes just how unusual and powerful Dracula is: strangely enough I did not want to hinder him. I suppose it is a part of the horrible curse that this happens when his touch is on his victim This quote gives an image of Dracula to be very inhuman like just like the others. It gets the reader into the story line and makes the reader believe more and more that Dracula is truly supernatural. But it seemed that a long time had passed before he took his awful sneering mouth away. I saw it drip with the fresh blood This can only be the action of a supernatural, as no human would even think of consuming someone elses blood. Dracula is a natural vampire as this sentence finally suggests and just shows what lengths the supernatural go to. Once again here a monster like image is created of Dracula and the instant feeling of fear kicks in as you read the sentence. The main reason that this sense of fear is created by the writer is because of how graphic the script becomes and how detailed it is and once again this instantly creates a picture in your mind of Dracula commencing with these gruesome acts. When my brain says Come! to you, you shall cross land or sea to do my bidding This describes a sense of power, which comes from Dracula. This is typical as power is one of the Gothic conventions, which is used in this story to good effect as Dracula commands his presence and shows his power. Straight after this we go from power to the gruesome side of Dracula: With that he pulled open his shirt and with his sharp nails opened a vein in his breast This is very gruesome and creates a sense of sickness for the reader but its all in the nature of Dracula as the story shows and Bram Stoker makes this very graphic once again which sends shivers up the readers spine. But even this is not enough. The writer goes one step further here as he goes into more graphic content When the blood began to spurt out, he took my hands in one of his, holding them tight, and with the other seized my neck and pressed my mouth to the wound, so that I must suffocate or swallow This once again is very sickening as it goes into great detail of how she is made to press her mouth against the blood spurting breast of Dracula. This creates a sickening image, which causes the reader to react in a way where he/she just wants to put the book down. As we move on to another extract in the story. We come to the part of the story where the Professor encounters Dracula himself.

Violence: A Means to an End? The use of violence to further various political and social movements occurs throughout Latin America and its history. Its long-term effectiveness in a social context, however, is dubious. Although many of these revolutions proved initially successful in accomplishing their stated purpose, especially in the political arena, eventually the drastic changes cause regression or create a sort of culture of instability within the nation. The Haitian Revolution and the Mexican War of Independence exemplify this standard. Seen as huge successes in their time, these historical revolutions have caused deterioration in the current state of affairs in the respective nations. Despite the lasting changes they have brought about in the system of power in the country, they affected the masses little. Nations such as Cuba have seen a forceful removal of the government, which in its very purpose was designed to alter the structure of society. In these cases, violence alone is not enough to cause chan ge, but may serve to build momentum that in turn, makes change possible. Instead of the sole use of violence and intimidation tactics to force submission and support, widespread popular backing is exactly what is needed for a successful movement; a small but loyal constituency of oppressors, a significant number of oppressed, and a large amount of firepower may accomplish goals in the short-run, but will fall short of achieving lasting change. The effectiveness of a large movement by the people also lessens the success of violence in counter-revolutionary attempts. Behavior Management of Exceptional Children

BEHAVIOR MANAGEMENT OF EXCEPTIONAL CHILDREN: TRANSITION SERVICES Transition Services is defined by the 1997 Amendments to the Individuals with Disabilities Act (IDEA) as a coordinated set of activities for a student, designated within an outcome-oriented process, which promotes movement from school to post-school activities including: post-secondary education, career training, adult services, independent living, community participation, and integrated employment (including supported employment. The coordinated set of activities shall be based upon the individual needs of each student, taking into consideration his/her preferences and interests. IEP goals and objectives are required for the following areas: * Instruction * Related Services * Community Experiences * Development of employment and other post-school adult living objectives * Daily living skills and functional vocational evaluation are required. â€Å"The importance of the transition specialist, or career education specia list, in the types of projects cannot be underestimated. The relationships these staff members maintain with the participants are crucial to the structure and success of these services†(Bullis and Cheney, 1999). Vocational Assessments Vocational Evaluation is a comprehensive process that systematically uses work activities, (either real or simulated), as the focal point for assessment of capabilities, vocational exploration and guidance. The purpose of vocational evaluation is to assist individuals in vocational development. Vocational evaluation incorporates medical, psychological, social, vocational, cultural, and economic data into the assessment process to determine realistic vocational areas. Transition Planning Transition planning begins at a very early age. It continues through each educational phase of the student's life, culminating with adult living. A continuum of services focuses upon a student's preparation for transition through participation in career awareness activities, career exploration, vocational training and employment. A continuum of Transition Services has been developed to serve as a guideline for transition planning. The continuum begins at preschool and ends at age 22. Transition planning is documented in the Individualized Education Program (IEP) beginning at age 14. â€Å"There is a lack of student and parent output, little documentation of transition plan specifics for each student, and IEP that were almost exclusively academically focused with no obvious links between goal/objectives and transition outcomes. Indeed, these weaknesses in the use of the IEP process and document planning for transition directly affect the implementation of transition services†(Collet-Klingenberg, L. L. , 1998). It is the responsibility of the IEP chairperson – usually the special education teacher – to arrange IEP / transition planning meetings for students at age 14 and older. The IEP notice to parents must include the following information: * The purpose of the IEP meeting is to develop / review the IEP and to consider Transition Services for inclusion into the IEP. * The student is invited to attend the IEP meeting. * Appropriate agency representatives have been identified and invited to the IEP / transition planning meeting. The IEP transition meeting must include all required IEP participants, plus two other representatives, as follows: * Parents or Legal Guardians * Special Education Teacher * Regular Education Teacher * Public Agency Representative (if appropriate) * Student * Other Individuals at the discretion of the parent or agency * Interpreter, when the parent or legal guardian is deaf or not proficient in the English language. * Career Education Teacher / Coordinator If the student does not attend the meeting, steps should be taken to ensure that his/her preferences and interests are considered. If an invited agency representative is unable to attend the meeting, other steps shall be taken to obtain participation. The IEP /Transition Planning meeting participants will provide input for expected outcomes. The following questions may be discussed. * What are the interest, preferences, and goals of the student after graduating or exiting school? * What support would be required to reach post-secondary goals? * Will the student be referred to an adult agency? * What type of adult agency service(s) is needed after graduation, if any? Who will be responsible for the referral(s) (i. e. special education teacher, the school based staff, parent, student, others? * Who will follow-up to ensure that the linkage between the school and adult agency(ies) was established? The IEP Team will develop transition goals and objectives that focus on the desired adult outcomes (long range transition goals). Students' preferences, strengths and limitations, career / vocational skills development, n eeded support services, job availability, medical and transportation requirements are also considered. Parents' expectations of desired student outcomes should be obtained and considered. What exactly is the Transition Plan? The Transition Plan is a part of the IEP. It includes long-range transition goals, indicating the students' preferences and interests after exiting school, are identified. â€Å"The skills needed to be successful in post secondary educational and vocational; settings, such as self-awareness, awareness of appropriate career options, and the ability to engage in self-advocacy when necessary, takes many years to develop† (Janiga,s. , J. ; Costenbader, V. 2002). Transition Services needed to achieve the long-range goals are determined. Agencies involved in transition planning while the student is still in school should be identified. That involvement is considered â€Å"agency linkages†. Transition goals and objectives are written. Agency responsibilities should be recorded in the IEP on the Transition Plan. Transition activities (objectives), persons re sponsible for the activities, and timelines are recorded. If an agency fails to fulfill its responsibilities, the IEP Team must reconvene to identify alternative strategies. Transition plans are reviewed, discussed and developed annually. The special education teacher, who completes the Transition Checklist, maintains a summary of transition planning. The Transition Checklist is reviewed and updated annually at the IEP meeting. A copy of the Transition Checklist is provided to the parent / guardian for further reference and planning. To assist in the development of transition plans at the IEP meeting Guidelines for transition services agenda is used. The guidelines outline what should be done before, during and after the IEP meeting. Records Keeping The special education teacher maintains a portfolio for each student, beginning at age 14, or grade 9. The portfolio documents a collection of evidence of the student's skills, abilities, and employment competencies (see your school's Special Education Coordinator or your school-based Transition Coordinator to obtain the portfolio). The student is responsible for participation in the development and maintenance of his / her transition portfolio. Portfolios are maintained as documentation of transition services activities. Adult Agencies An adult agency representative can attend IEP / Transition meetings for students who are 16 years of age, or in the 11th grade, and thereafter, if considered necessary by the IEP Team. An agency representative may attend IEP / Transition meetings for student's age 14 or younger, if considered necessary by the IEP Team. Some students will move from school to adult life requiring little or no more involvement with adult agencies than their non-disabled peers. Examples of such agencies or services are community colleges, vocational technological schools, other post-secondary educational institutions and the military. Other students may require time-limited adult services, such as the Rehabilitation Services Administration (RSA). There are also students who will need ongoing support from adult agencies such as the Mental Retardation and Developmental Disabilities Administration (MRDDA). The IEP Team will determine which services may be appropriate for such students. Adult agencies may include, but are not limited to, the following: * Rehabilitation Service Administration Mental Retardation and Developmental Disabilities Administration * Commission on Mental Health Services * Others Private agencies representation may be invited by parent / guardian or student of appropriate: * College / Community College * Vocational Technical Schools * Adult Education Services/ Training * Armed Forces * Others Transportation for Special Education Transport ation is a related service for special education students when it is necessary in order for a student with a disability to participate in an appropriate educational program. The Multi-Disciplinary Team (MDT) makes individual decisions about transportation during the development of the Individualized Education Program (IEP) and placement. The MDT must consider the following: * Determine a need for specialized transportation and reflect the need in the student's IEP * Review the student's need for transportation at any IEP review * Qualifications for transportation include the following: * Limited sensory or physical endurance Significantly reduced intellectual development; and/or reduced problem solving skills Parents must do the following in order for transportation to be provided for their children: * Provide accurate address information to the Division of Special Education and ensure that it is updated if necessary during the school year * Call your child's principal of any address changes during the school year. It can take 3 to 10 school days to make transportation changes during the school year * Have your child ready when the bus arrives in the mor ning * Meet the school bus in the afternoon. At this point in our lives, we as a society spend a lot of time at work and I think some of us recognize that life is just too short to spend all that time doing something we dont love or enjoy doing. When I think back to my last years of high school it was very carefree when I needed someone to say to me Hey! You have to think about your future! What are you going to do for the rest of your life? My mind at that point only went as far as the end of school. At the end of school I ended up drifting in and out of meaningless jobs not knowing which direction I wanted to go because I had never thought of where I wanted to be. I had only ever thought about where I was. Soon something happened which would eventually set me on a path I never envisioned myself on. I got pregnant. Having a child of course changed my life in ways in ways I never imagined possible. One way in which my life was changed is that I basically put any thoughts of a career on hold as I put all my energies towards this child. Having a child was a learning process and I learned many things about myself such as Im a very nurturing person and Im a very patient person. This would soon set me on a path in Early Childhood Education as I would start volunteering at my sons preschool. It was something that I learned I was good at and I pursued that career because aspects of it made me so happy. Being around children was easy and fun, like being with my own child. It just made sense at the time. I have been working with children for about five years now. I have preschool experience, daycare experience and I even ran a daycare out of my home for a short time. Now my children are getting older and slowly I came to realize that this wasnt what I wanted to do anymore. There are downsides to this profession that get in the way of my happiness which I cant ignore anymore. I started to feel like I needed a new challenge and I thought of pursuing Teaching but when I thought of spending the next thirty years of my working life doing just that, there was no excitement. Teaching was not for me. At the time when I had all these questions in my head I happened to get a massage. I really liked the interaction between therapist and client. I decided to find out as much as I could about the profession by reading and surfing the net and I liked what I was finding out. There was so much to Massage Therapy that I never knew about. Like a lot of people I had preconceived notio ns about the profession. I have always been interested in health and healing and entering into the Massage Therapy program allows me to pursue those interests. The Role of John Proctor in Arthur Miller's The Crucible Arthur Miller wrote the play 'The Crucible' to show the historical parallel between the Salem witch trials of 1692 and the McCarthy 'witch' hunt of the late 1940' and 50's. The character John Proctor seems to represent and show the viewpoint of a real man, unaffected by hysteria; a difficult thing to portray during the 1950's in the USA, due to the fear and hate of Communism and the 'witch' hunt for communists. John Proctor is the central character of the play. He a realistic character, the audience can relate to him and sympathize with him. He is a somewhat strong character and is described by Miller as "powerful of body, even-tempered and not easily led", the last comment perhaps being the most important. His character earns respect throughout the play as the audience sees the moral arguments he has and internal conflicts he has to deal with. John Proctor is a man with a guilty conscience, which makes him indecisive until it is too late, audiences can relate this to their own, maybe far less dramatic lives. John Proctor has made a mistake; he has slept with his former servant girl, teenage Abigail Williams. It is also shown in Act 1 that he still lusts after her - when she asks if he looked up at her window for her, he replies "I may have looked up", this shows his characters weakness, but he remains strong willed. He does not give into what he obviously thinks of as great temptation, again. This shows the audience that he has recognized his mistake and is not repeating it. John Proctor is an honest man, but has undermined himself with his one act of dishonesty. ... ... parallel, as he knew himself what height the communist hysteria had reached. Like the witch hysteria in Salem, he knew that he would be persecuted for writing about fear and conscience if he were to set the play in contemporary America. Miller uses John Proctor to almost play himself and to show what he would do if put in the position of being on trial. He later proved his point by not accusing any other people of being in communist parties when he really was put on trial, to get himself off the hook, like so many other people did. John Proctor plays the crucial role in 'The Crucible' of being the man that is on the brink of giving in but stands strong, even though he knew that one individual would not bring down the hysteria. Before looking at if the intention to create legal relations should be used to replace consideration, it is important to look at how these doctrines fit into the essential elements in a contract. Their use will then be discussed, together with the doctrine of promissory estoppel. In evaluating these principles reference will be made to case law, judicial comment and of leading contract academics work. Finally, thought will be given to the future of consideration, and if it is still necessary today, when so many other countries have adopted alternative approaches to ensuring that contracts are binding. In the formation of contracts two elements are vital. Firstly, the â€Å"offer,† an indication by one person prepared to contract with another, on certain terms, which are fixed, or capable of being fixed at the time the offer is made.[1] Secondly, there must be an â€Å"acceptance†, an unconditional assent to a definite offer.[2] These two combine to create certainty that a contract has been formed, for, as in Scammell v Ouston (1941),[3] â€Å"if an agreement is uncertain on some important issue†¦the courts will hold there is no contract.†[4] Following this, the elements of consideration and intent provide the contract’s â€Å"body and substance†[5] So, what is meant by â€Å"consideration† and â€Å"the intention to create legal relations†? English law usually requires proof that the parties have made a bargain, or agreement,[6] this is known as the benefit and detriment test. (Currie v Misa (1875))[7] or † a benefit to one party or a detriment to another.†[8] So, in practical terms consideration can be defined as what one party in an agreement is giving, or promising, in exchange for what is being given, or promised, by the other side. [9] This provides mutuality, making the contract enforceable. The Oxford Dictionary of Law definition states, â€Å"Consideration is essential to the validity of any contract other than one made by deed. Without consideration an agreement not made by deed is not binding; it is a nudum pactum (naked agreement) governed by the maxim ex nudo pacto non oritur action (a right of action does not arise out of a naked agreement.)†[10] English law does not rely on formali ties as a way of identifying intention to create a legally binding contract. Instead it focuses on offer, acceptance and consideration.[11] If these are present,  and unless rebutted by contrary evidence, courts operate on the basis of two legal presumptions, that there is no intention to be bound in domestic or social arrangements, but there is intention to be bound in commercial agreements.[12] Professor B.A.Hepple claims that there is no need of a separate requirement of intention, and that a bargain, involving mutuality is sufficient. These views are not generally accepted as it is widely agreed that identifying the parties’ intentions is essential to the role of the courts when establishing if a contract was made.[13] (mf†¦) It is useful to look at why English law has become so reliant on the consideration element of a contract, and why it has frequently been used as the â€Å"badge of enforceability,†[14] Professor Atiyah argues that â€Å"consideration† originally meant a â€Å"reason for enforcing an agreement.†[15] Early forms of contract law mainly involved agreements regarding debt, covenant, or detinue ie., wrongful detention of property, and were only binding if under seal. This method, which required a degree of form such as writing or a deed, was used to prevent fraud and proved that there was an intention to create legal relations. Consideration was first used in the sixteenth century when, in order to enforce informal agreements, the law of assumsit was developed.[16] So, while that the law would, â€Å"†¦still not enforce merely gratuitous promises, †¦ the law had to develop an element that could distinguish between a proper contractual agreement, and somethin g less that would not.†[17] Due to the Law of Property Miscellaneous Provisions Act 1989, form is still required for contracts involving the sale of land. It is also used to offer consumers protection in hire purchase and consumer credit agreements. In the English Common law system, a promise is not legally binding as part of a contract except if it is made in a deed or supported by some consideration. [18] Sir Guenter Treitel Q.C., describes the purpose of consideration as,  Ã¢â‚¬Å"†¦to put some legal limits on the enforceability of agreements even where they are intended to be legally binding and are not vitiated by some factor  such as mistake, misrepresentation, duress or illegality.†[19] This is a peculiarity found only in English law. In some civil law countries, promises that in England would not be considered binding due to â€Å"lack of consideration,† can be enforced if they have been made in some notarised writing. The European Civil Law systems were formed around the fifteenth century and based on the Roman Catholic Code of Canon law and the value of good faith. Due to this, their courts take the view that all lawful and sincere agreements are contracts.[20] As English law has developed there has been an insistence on the use of consideration and intention to create legal relations in order to enforce a contract. (Balfour v Balfour (1919))[21] Although it may not be easy to find consideration in a contract, (Ward v Byham (1956))[22] it could be asked why it is thought to be necessary at all. Originally, the basic idea of consideration was to show that A had bought B’s promise.[23] (Dunlop Pneumatic Tyre Co Ltd v Selfridge & Co Ltd (1915))[24] However, there was a general principle of non-interference in the concerns of other people. Therefore, the doctrine was not strictly enforced; it was enough to provide sufficiency of consideration it did not have to be adequate. This meant that, â€Å"the consideration provided by one party need not equal in value the consideration provided by the other party.†[25](Thomas v Thomas (1842))[26] Since this case it was assumed that consideration must have at least some economic value, and that it must be, â€Å"†¦something which has some value in the eye of the law.†[27] (mf†¦) The use of the word â€Å"sufficiency† also causes uncertainty. Courts have decided it must be real, not as in White v Bluett (1853)[28] where a son tried to use a promise to stop complaining over the distribution of his father’s property as consideration. Although, there was an economic element, as a father promised not to enforce the repayment of a debt owed to him by his son, it was held that, â€Å"The son had no right to complain, for the father might make what  distribution of his property as he liked; and the son’s abstaining from what he had no right to do can be no consideration.†[29] In this case the court took the view that this type of moral obligation could not be used as any form of value, in other cases the courts appear to almost invent consideration so contracts can be enforced.[30] As in Ward v Byham (1956) where â€Å"happiness† was used. In Chappell & Co v Nestle Co Ltd., (1960),[31] the House of Lords held that chocolate wrappers needed to buy records in a special promotion were part of the consideration. The wrappers had no monetary value, for upon receipt Nestle’s would simply discard them.[32] Therefore, even something valueless could be used as consideration. From this it can be seen that consideration does not guarantee fairness of bargains. Indeed it could be argued that, as this would not fit the benefit and detriment test, this type of â€Å"nominal bargain†[33] should not be allowed. This is the most problematic area of the rules surrounding consideration. To start with, the fact that consideration need not be adequate, just sufficient, means it does not need to be of equal value to that which the other party is offering. This could lead to injustice. There could be some perfectly good reason why A sells his Mercedes to B for a token amount, but what if he is under duress, perhaps being blackmailed by B.[34] Similarly, it is quite fair that, as in Stilk v Myrick (1809)[35] performance of an existing contractual duty was held to be insufficient consideration. An employee should not be allowed to hold his employer to ransom in this way, unless it is proven that the situation changed significantly, and he has undertaken a considerable extra workload after the promise of extra pay. (Hartley v Ponsonby (1857))[36] So why do the courts permit the token element in bargains at all? It has been said that, â€Å"consideration was originally the reason for the enforcement of a promise.†[37] Therefore, even token bargains have a purpose by providing evidence that the parties take the agreement seriously, and show an intention to create legal relations. The doctrine of consideration was also used was where alteration promises were made regarding the part payment of debts. The general rule as established in Pinnel’s’ case (1602)[38] was that â€Å"the gift of a horse, hawk or robe, etc in satisfaction is good.† [39] The assumption being that providing something in consideration might be more beneficial to the plaintiff than waiting for the money.[40] This rule was confirmed in the House of Lords in Foakes v Beer (1884)[41]. This â€Å"practical benefit† was also the principle in Williams v Roffey Brothers (1990)[42] where it was advantageous to pay more for the same work. However, the rule in Pinnel’s Case can be avoided by providing â€Å"extra consideration, altering the way payment is made, by paying earlier, at a different time or place or via third party.†[43] Possibly due to this, the Law revision Committee 1937 recommended the abolition of the rule in Pinnel’s Case, but so far t hat has not happened.[44] Lord Denning tried a different approach with his use of the equitable principle of promissory estoppel. In his obiter statement in Central London Property Trust v High Trees House (1947),[45] he stated that, † a promise intended to be binding, intended to be acted upon, and in fact acted on, is binding so far as its terms properly apply.[46] Due to this it was held that a promise could be enforced without consideration if it would be wrong for that person to go back on a promise and there has been a reliance on it.[47] He based his views on Lord Cairns’ comments in the earlier â€Å"equitable waiver† case of Hughes vMetropolitan Railway (1877)[48] It has been suggested that the promisee must have suffered a detriment from reliance on a promise. Lord Denning denied that this was necessary, claiming that someone just needed to have â€Å"acted on the belief induced by the other party.† (W J Alan & Co v El Nasr (1972))[49]. Other limitations exist, promissory estoppel only applies to the modification or discharge of an existing contractual obligation, [50] therefore â€Å"equity is a shield not a sword,† it will not allow someone to use equity to instigate a cause of  action.[51] (Coombe v Coombe (1951)[52] The promise not to enforce rights must be clear and unequivocal, in The Scaptrade (1983)[53] it was held that the fact that they hadn’t enforced their full rights in the past was not sufficient. It must be inequitable for the promisor to go back on his promise, in D & C Builders v Rees (1966)[54], Mrs Rees had forced the builders to accept her cheque by inequitable means and so could not rely on promissory estoppel,[55] for â€Å"he who comes to equity must do so with clean hands.† [56] This doctrine is also contrary to the House of Lords decisions in Jorden v Money ( 1854)[57] and Foakes v Beer (1884) As can be seen from these cases, unlike in the past when a gentleman’s word was his bond, people can no longer be relied upon to keep gratuitous promises, however seriously meant. They are also likely to use litigation if they later wish to go back on them. Treitel points out that, † the doctrine of consideration has attracted much criticism, â€Å"[58] as even the most flimsy evidence is given as consideration, so its use has become somewhat dubious. â€Å"The doctrine is an historical accident; that foreign systems do without.† [59]To overcome these problems, Parliament could extend the scope of existing legislation by using form to prove the intention to create legal relations in more situations than now. That would mean that although not needed for basic everyday events like shopping, or private domestic arrangements; eg., babysitting, all other contracts of a financial or contractual nature would have to have written agreements. As Treitel says, † English law does recognise, in the deed, a perfectly safe and relatively simple means of making gratuitous promises binding.† [60]These would be subject to the usual rules applying to the Sale and Supply of Goods Act 1994, the Consumer Protection Act 1987, the Supply of Goods and Services Act 1982, etc., In the event of a dispute regarding a contract with no written agreement, the courts could consider it to be void, as there was no proof of an intention to create legal relations and therefore the contract has no legal effect. Any money paid out under such a contract would be recoverable and any work that has been done maybe compensated on a quantum meruit basis.[61] Care would also have to be taken to ensure the rights of third parties are protected.[62] The use of form as proof of the intention to create legal relations would provide a â€Å"useful safeguard against rash  promises.†[63] Although, â€Å"this does not solve the problem of action in reliance on an informal promise†¦ the court maybe able to give some effect to the promise under the doctrine of waiver or in equity.†[64]
